In a new lawsuit, subscriber Genevieve Capolongo claims the streaming giant’s Discovery Mode and editorial playlists promote tracks from major artists like Drake, Justin Bieber, and Zach Bryan because Spotify is paid to do so. She says she mostly listens to indie musicians like Próxima Parada, Julia Cooper, and Brusco, but Spotify keeps recommending mainstream hits — and that’s no coincidence.
According to Capolongo’s lawyers, Spotify’s system is a “modern form of payola,” a deceptive pay-for-play setup where labels secretly pay to boost their songs. She insists she wouldn’t have subscribed had she known that “recommendations were sold to the highest bidder.”
Spotify fired back, calling the lawsuit “nonsense” and “full of inaccuracies.” Still, the case targets a controversial feature that’s long raised eyebrows and comes amid growing scrutiny of Spotify’s platform practices.
